TDSAT rules against cable ops, slams oral interconnect deals

Mumbai: The Telecom Disputes Settlement & Appellate Tribunal (TDSAT) disposed of three petitions filed by the Karnataka State Digital Cable TV Operators’ Welfare Association and the Cable Operators’ Sangram Association, Kolkata, against multi-system operators (MSO) Siti Cable Networks Ltd and Hathaway Cable & Datacom Ltd. Disposing of their petitions, Justice Aftab Alam said that the local cable operators (LCOs) who had petitioned the TDSAT had entered into informal oral arrangements on interconnection deals, which are legally invalid. The judge cited Clauses 5 (17) to 5 (20) of the Interconnection Regulations 2012, which make written agreements between MSOs and LCOs mandatory. These clauses make it mandatory for MSOs to put terms and conditions of interconnection agreements in writing. The clauses state that no MSO shall make signals of TV channels available to any linked LCO without entering into a written interconnection agreement. The judge noted that the Telecom Regulatory Authority of India (TRAI) had amended regulations to plug even the little loophole that was misused for continuing the supply of signals under DAS transmission even after the expiry of that agreement. “Further, by another amendment to the regulations, it has removed the ambivalence that was created in the scheme of interconnections as a result of fixing the shares of the MSO and the LCO by a tariff order dated 10 July 2010, as amended on 30 April 2012,” he observed. “The two amendments in the Interconnect Regulations 2012 made by TRAI during the pendency of these petitions leave nothing for adjudication in these matters and all that is required is to direct the parties to simply follow the law,” he observed. “These three cases concerning around 375 LCOs operating in two different parts of the country, Bengaluru and Kolkata, are illustrative of the malaise of distributors of TV channels entering into interconnection arrangements without any agreement in writing (or at any rate a definitive agreement) as mandated by law. In the short run, oral arrangements may appear expedient and profitable, but with the passage of time, the relationship becomes both strained and hurtful and then one of the two sides approaches the Tribunal for redressal of its grievances. This is what has happened in the three cases and a number of similar cases pending before the Tribunal,” Justice Alam said, dismissing the petitions. “Here it needs to be emphasised that these three petitions do not make an isolated case. Actually, a large percentage of cases coming to the Tribunal from the broadcasting sector have their root cause in the absence of any agreement in writing between the parties. Further, and what is more regrettable, the cases in which two distributors of TV signals happen to be in interconnection arrangement without any agreement in writing is not confined only to analogue transmission but arise almost in equal numbers under the DAS regime,” the judge observed.

 • The recall includes both variants of the S-Cross - DDiS 200 and DDiS 320
 • The faulty component could cause seepage of the brake fluid
 • The replacement of the faulty component will be done free of cost
[Image: maruti-suzuki-s-cross.jpg?v=3]

Maruti Suzuki has announced that it soon undertake a 'service campaign' to inspect a suspected fault and replace a brake part in 20,427 units of the S-Cross. The faulty component was found in the S-Cross units manufactured between April 20, 2015 to February 12, 2016 and includes both variants DDiS 200 (1.3-litre diesel) and DDiS 320 (1.6-litre diesel).

Maruti suggests that the S-Cross with faulty components could have brake fluid seepage due to the faulty part. Upon inspection, a warning light will glow on the instrument cluster revealing the issue. The service campaign will see technicians inspect and replace the faulty component, should the need be. The company confirmed that the replacement will be done free of cost for the customer.

Maruti S-Cross owners can also check if their vehicle is part of the service campaign by logging on to www.nexaexperience.com and filling the 14-digit chassis number. Owners can also contact their respective company's dealerships to ascertain if their vehicle has been impacted.

Maruti clarified that since the exercise does not fall under the SIAM's voluntary recall code, it has refrained from using the term 'recall' in its communication. The company did state that service campaigns are undertaken globally by automobile companies to rectify faults that may potentially cause inconvenience to customers.

Recalls have now grown to be a part of the Indian automotive industry since it was applied in 2012. Several manufacturers recall a number of vehicles every year for minor or major issues globally. In India alone, around 18 lakh vehicles have been recalled by various manufacturers. Maruti too recalled 33,098 units last year of the Alto 800 and K10 models for defective latches on right side doors.

 • 2India will play three ODIs and T20Is each
 • 3India will play 17 Tests from now till March 2017
New Delhi: The national selection committee under Sandeep Patil are set to leave it to limited overs captain Mahendra Singh Dhoni to decide on whether he will make himself available or not for the short tour of Zimbabwe from June 11-20.
It has been learnt that the five selectors have spoken to most of the senior India regulars intimating them that they are keen to send a new look junior team to the African nation in order to test the bench strength.
According to a reliable BCCI source, the selection committee is likely to only make an exception for Dhoni keeping in mind that he will not have any international assignment till March next year during which India will play 17 Test matches.
"Yes, it is true that selectors have spoken to some of the senior Indian players intimating them that they would be looking at juniors during this tour. While Virat Kohli, Rohit Sharma, Shikhar Dhawan were set to be rested, there were some seniors, who had made themselves available for the tour. But selectors told them that only exception may be made for Dhoni, who no longer plays Test cricket," a top BCCI source told PTI.
"The selection committee has left it completely on Dhoni to decide whether he wants to go or not. He is free to opt out as he has also played a lot of cricket but if he does not go, he will not have a single limited overs assignment till March next year. In case Dhoni is reluctant, then Ajinkya Rahane is the likely choice to lead the side," the source added.
"Also Zimbabwe is a nine-day trip with all matches being held at the same venue (Harare Sports Club ground). It will not be hectic in terms of traveling also," the source further added.
The other objective will be to check out the youngsters, who have emerged after a good IPL season as to how they absorb the pressure of playing for the senior national team although Zimbabwe are not exactly the toughest side in international cricket.
Murali Vijay and KL Rahul are two players who have a fair chance of making it to the Zimbabwe bound tour. In fact Vijay last played limited overs cricket in Zimbabwe last year under Rahane's leadership. Rahul is also set to get a look in after an impressive IPL.
Among the pacers, Jasprit Bumrah, who is a regular in T20 Internationals may like to play the three ODIs adding to his kitty of a solitary 50-over match at the international level.
Mohammed Shami, Sandeep Sharma, Mohit Sharma are some of the contenders with Ashish Nehra already being ruled out for atleast four months due to a career-threatening hamstring tendon injury.
Leg-spinner Murugan Ashwin, all-rounder Krunal Pandya are some of the names that will be discussed. Some of the tested players like Amit Mishra, Piyush Chawla may also get a look-in but if the selectors opt for youth policy, they may not be considered. Ditto for KKR veterans Gautam Gambhir and Yusuf Pathan, who have done well but are in their mid-30's.

Sun TV shares sank as much as 14 per cent on Thursday as the opposition DMK, a favourite to win in Tamil Nadu according to exit polls, finished second behind ruling AIADMK.

Chief Minister J Jayalalithaa's AIADMK was leading in 126 of the state's 234 seats as of 4 p.m. Opposition DMK-Congress combine was ahead in 105 seats in Tamil Nadu.

Exit polls had predicted that Tamil Nadu will stick to the trend of voting in the opposition party - in this case M Karunanidhi's DMK in a strategic alliance with the Congress.

A victory for the AIADMK is a setback for Sun TV, whose top management is seen to be close to the opposition DMK, traders said. Chennai-based Sun TV is owned by Kalanithi Maran, the grandnephew of DMK President M Karunanidhi.

"Sun TV stock is driven by the way election results are going... The stock rose significantly on the back of exit poll results. Now, with the leads, the stock is moving where the trend is moving," said Lancelot D Cunha of Crest Wealth Management.

Mumbai: British lender HSBC on Thursday announced a consolidation exercise under which it will almost halve its branches in the country to 26 as customers shift to digital alternatives for their banking transactions.

The exercise will also lead to over 300 jobs being affected, which is less than one per cent of its total workforce of over 33,000 people in the country, and "redeployment opportunities will be accorded to the affected employees", the bank said.

"A key priority is the fair treatment of our staff and we will do everything we can to assist affected employees during this business transition. Redeployment opportunities will be accorded to the affected employees," it said in a statement.

The total number of branches will be coming down to 26 in 14 cities from 50 in 29 cities earlier, with a bulk of the impact in smaller centres.

It added that the impacted branches account for only 10 per cent of the customer base in the country. The reduction in branches is due to customers' adoption of digital solutions, it said.

"This change reflects changes in customer behaviour, who are increasingly using digital channels for their banking," the bank said.

"India is a priority market for HSBC and we will continue to invest to achieve sustainable growth by supporting the needs of our customers," HSBC India's chief executive Stuart Milne said.

The consolidation exercise is the result of a strategic review of retail and wealth management vertical and will be

Global Smartphone Sales Up 3.9% In Q1 2016: Report

$

0
New Delhi: Global sales of smartphones totaled 349 million units in the first quarter of 2016, up 3.9 per cent over the year-ago period, driven by demand for low-cost and 4G-enabled handsets, research firm Gartner said.

Smartphone sales represented 78 per cent of total mobile phone sales in the first quarter of 2016, it said in a report.

"Smartphone sales were driven by demand for low-cost smartphones in emerging markets and for affordable 4G smartphones, led by 4G connectivity promotion plans from communications service providers (CSPs) in many markets worldwide," Gartner said.

In a slowing smartphone market where large vendors are experiencing growth saturation, emerging brands are disrupting existing brands' long-standing business models to increase their share, Gartner Research Director Anshul Gupta said.

"With such changing smartphone market dynamics, Chinese brands are emerging as the new top global brands. Two Chinese brands ranked within the top five worldwide smartphone vendors in the first quarter of 2015, and represented 11 per cent of the market," he added.

Samsung led the market with 23.2 per cent share, followed by Apple (14.8 per cent), Huawei (8.3 per cent), Oppo (4.6 per cent) and Xiaomi (4.3 per cent).

"Samsung's Galaxy S7 series phones and renewed portfolio positioned it as a strong competitor in the smartphone market, and more so in the emerging markets where it has been facing fierce competition from local manufacturers," Mr Gupta said.

On the other hand, Apple had its first double-digit decline year-on-year, with iPhone sales down 14 per cent. Lenovo disappeared from the top five smartphone tally in the first quarter of 2016.

"Lenovo had another challenging quarter with its worldwide smartphone sales declining 33 per cent... Lenovo is also struggling to bring synergies with Motorola's device business, managing lower costs and overheads of the two brands," Mr Gupta said.

In terms of the smartphone operating system (OS) market, Android regained share over iOS and Windows to achieve 84 per cent share.

Apple's iOS had 14.8 per cent share, while Windows and BlackBerry had 0.7 per cent and 0.2 per cent share, respectively.

Washington: A major earthquake, of magnitude 8 or greater, may strike Jammu and Kashmir , endangering the lives of as many as a million people, latest geologic mapping in the Himalayan mountains of the state suggests.
Scientists have known about the Riasi fault in Jammu and Kashmir, but it was not thought to be as much as a threat as other, more active fault systems.
However, following a magnitude 7.6 earthquake in 2005 on the nearby Balakot-Bagh fault in the Pakistan-occupied Kashmir - which was not considered particularly dangerous because it was not on the plate boundary - researchers began scrutinising other fault systems in the region.
They found that the Riasi fault has been building up pressure for some time, suggesting that when it does release or "slip," the resulting earthquake may be large - as much as magnitude 8.0 or greater.
"What we set out to learn was how much the fault has moved in the last tens of thousands of years, when it moved, and how different segments of the fault move," said Yann Gavillot, lead author on the study who did much of the work as a doctoral student at Oregon State University in the US.
"What we found was that the Riasi fault is one of the main active faults in Kashmir, but there is a lack of earthquakes in the more recent geologic record.
"The fault hasn't slipped for a long time, which means the potential for a large earthquake is strong. It's not a question of if it's going to happen. It's a matter of when," said Gavillot.
There is direct evidence of some seismic activity on the fault, where the researchers could see displacement of the Earth where an earthquake lifted one section of the fault five or more meters - possibly about 4,000 years ago.

New Delhi: Cricket Association of Bihar (CAB) secretary Aditya Verma on Thursday threatened to file a case of perjury against Board of Control for Cricket in India (BCCI) secretary Anurag Thakur.
"My legal team is ready to file perjury against Anurag Thakur for his false statement in the Supreme Court during the hearing of SLP no 35160/13 & Civil appeal 4235, 4236/14 & 1155/15 in the matter related to affiliation of Bihar Cricket," Verma said in a statement.
"We have enough affidavits of Anurag Thakur which showed that how they tried to cheat the young cricketers of Bihar by given continuously wrong statements on oath in the highest court of the country," the statement added.
Verma also added that "from last 16 years, after the bifurcation of the state of Bihar, the budding cricketers of Bihar have failed to show their talents at the state, national or international level due to step-motherly behaviour of BCCI".
